Election Day!

Short post today. I’ll comment only on one topic: Sacramento’s Measure O. If it passes, Sacramento would essentially become the first California city to allow residents to sue the city for “harm [caused] by unlawful camping or unlawful storage on City-owned property.” If the plaintiff wins the case, Sacramento would be required to cover “their costs and attorney’s fees.”

The measure also, for the first time to my knowledge, defines an “encampment” (four or more persons camping together or within 50 feet of each other, without permitted power, water, or bathrooms), but on the other hand it seems to conform with Martin v. Boise standards whereby, in a complicated formula, the Sacramento City Manager must “authorize new emergency shelter spaces to homeless people.” This part of Measure O, though, is murky.

Measure O, while not perfect, at least represents the intention of one California city—its capital city—to fight back against the proliferation of encampments that has been so destructive to places like Oakland. I’ll be watching to see if Sacramento voters pass Measure O, and by what majorities. I hope it wins big.
